Terms of Service

1. Acceptance of these terms

By creating an account or using PokerBox (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

2. The service

PokerBox is a poker session and bankroll tracking application. It lets you record sessions, transactions, and related data, view analytics, and use companion tools. We may add, change, or remove features at any time.

3. Eligibility and accounts

You must be old enough to form a binding contract in your jurisdiction (and at least 13). You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized use.

4. Subscriptions and payments

Some features require a paid subscription. Subscriptions are billed by Apple or Google through your App Store or Play Store account, not by PokerBox directly.
  • Subscriptions automatically renew at the end of each billing period unless you turn off auto-renewal at least 24 hours before the end of the current period.
  • You can manage and cancel your subscription in your App Store or Play Store account settings. Deleting the app does not cancel your subscription.
  • Refunds are handled by Apple or Google according to their policies.

5. Free trials and introductory offers

If we offer a free trial or introductory offer, you must cancel before the trial ends to avoid being charged. Eligibility for trials is determined by Apple or Google. Any unused portion of a free trial is forfeited if you purchase a subscription before the trial ends.

6. Acceptable use

You agree not to: use the Service for any unlawful purpose; reverse engineer or attempt to extract source code; interfere with the integrity or performance of the Service; access the Service through automated means without our written permission; or use the Service to harass, defraud, or harm others.

7. Your content

You retain ownership of content you create in the app, such as session entries and recorded hand notes. You grant us a worldwide, non-exclusive, royalty-free license to host, store, transmit, and process your content solely to operate the Service on your behalf. You are responsible for the legality of the content you submit.

8. Intellectual property

The Service, including its software, design, and trademarks, is owned by us or our licensors and is protected by intellectual property laws. We grant you a personal, limited, non-transferable, non-exclusive license to use the Service in accordance with these Terms.

9. Disclaimers

The Service is provided on an “as is” and “as available” basis. PokerBox is a tracking and information tool; we do not provide gambling, financial, or legal advice. We make no warranty that the Service will be uninterrupted, error-free, or fit for any particular purpose, to the maximum extent permitted by law.

10. Limitation of liability

To the maximum extent permitted by law, PokerBox and its officers, directors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising out of these Terms or your use of the Service is limited to the amount you paid us in the twelve months immediately preceding the claim.

11. Termination

You may stop using the Service at any time and delete your account from Settings. We may suspend or terminate your access if you violate these Terms or if we reasonably believe your use poses a risk to others or to the Service. On termination, the licenses granted to you in these Terms end.

12. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will notify you in the app or by email. Your continued use of the Service after the changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the Commonwealth of Australia, without regard to its conflict-of-laws principles. Any dispute will be resolved in the courts located in that jurisdiction, except where applicable law gives you the right to bring a dispute in your local jurisdiction.
